Terms and Conditions (T& C)

for the Provision of Photographic Services by GentleFrame (Florin Zlatar)

§ 1 Scope
(1) These General Terms and Conditions (T& C) apply to all contracts between GentleFrame (Florin Zlatar), hereinafter referred to as the „Contractor“, and his clients, hereinafter referred to as the „Client“.
(2) Deviating terms and conditions of the Client shall not be recognized unless the Contractor expressly agrees to their validity in writing.

§ 2 Conclusion of Contract
(1) The contract is concluded by written order confirmation from the Contractor (via email) to the Client.
(2) The Client is obliged to check the data contained in the order confirmation for accuracy immediately and to notify the Contractor of any errors.

§ 3 Services of the Contractor
(1) The exact scope of services is defined in the written agreement (quote/order confirmation).
(2) The creative execution is at the artistic discretion of the Contractor, unless explicitly agreed otherwise.
(3) The Contractor reserves the right to abort or refuse photographic work if conditions at the event location are potentially harmful to the equipment (e.g., laser radiation sources that can permanently damage camera sensors). In this case, the Contractor reserves the right to payment of the full agreed fee.
(4) The edited image material will be provided to the Client in high-resolution JPG format in a password-protected online gallery on wfolio.com. There is no entitlement to the handover of RAW data.
(5) The delivery period for the photos is 5 weeks after the photo session. Separate deadlines apply for additional services (e.g., albums).

§ 4 Duties of the Client
(1) The Client undertakes to provide all information necessary for the execution of the shooting (location, time, schedule, special requests) in a timely manner.
(2) The Client ensures that no conditions exist at the event location that endanger the Contractor’s equipment (e.g., lasers, extreme humidity, sandstorms).

§ 5 Copyright and Usage Rights
(1) The Contractor remains the author of all photographs taken (§ 43 German Copyright Act - UrhG).
(2) The Client receives a simple, non-transferable right of use for the private, non-commercial use of the delivered images.
(3) Any commercial use, editing of the images, or transfer to third parties requires the separate written consent of the Contractor.
(4) The Contractor is entitled to use the images for their own advertising and marketing purposes (website, social media, portfolio), unless the Client objects in writing.

§ 6 Remuneration and Payment Terms
(1) The remuneration is based on the valid price list at the time of conclusion of the contract or the individual quote.
(2) All prices are in Euros and include the statutory value-added tax (VAT).
(3) Upon booking, a deposit of 30% of the order value is due. The remaining balance is payable within 3 days after the shooting and before the delivery of the images.

(5) Not included in the price are travel costs for distances over 25 km (one way) from Albstadt (0.50 €/km) as well as any applicable accommodation and travel expenses.

§ 7 Cancellation and Withdrawal
(1) In the event of cancellation by the Client, the following cancellation fees apply:
- Up to 90 days before the date: 30% of the order value
- 89 to 30 days before the date: 50% of the order value
- 29 to 14 days before the date: 75% of the order value
- From the 13th day before the date: 100% of the order value
(2) The Client is entitled to prove that the Contractor has incurred no or lesser damages.

§ 8 Liability
(1) The liability of the Contractor for slight negligence is excluded.
(2) Liability for data loss is limited to the point of handover of the images to the Client.
(3) The Contractor is not liable for restrictions in performance due to force majeure (illness, severe weather, etc.).

§ 9 Data Protection
The processing of personal data is carried out in accordance with the separate privacy policy on the website.

§ 10 Final Provisions
(1) German law shall apply.
(2) The place of performance and jurisdiction is Albstadt, Germany.
(3) Should any provision of these T& C be or become invalid, the validity of the remaining provisions shall remain unaffected.
